Farm & Rural Supplies Terms and Conditions
This website is operated by Farm & Rural Supplies and throughout the site, the terms (“we/us/our”) refer to Farm & Rural Supplies. Set out below are the Terms and Conditions on which we will supply products (the “products”) listed on our website: http://www.farmandruralsupplies.co.uk (the “site”) to you the consumer (“you”/”your”). These Terms and Conditions are the contract between you and Farm & Rural Supplies. By visiting or using our website, you agree to be bound by them and all other policies referred to within these Terms and Conditions and on the Farm & Rural Supplies website. Any contract for any products which you purchase using the site will be between you and Farm & Rural Supplies. Farm & Rural Supplies is part of Elipse International Ltd. Before purchasing any products on the site please read these Terms and Conditions carefully. You should understand that by purchasing products, you agree to be bound by these Terms and Conditions and should record a copy for future reference. These Terms and Conditions apply to all users of the site. If you do not agree to all the Terms and Conditions of this agreement, please leave this site immediately.
- Purchase of ProductsBy purchasing products through our site, you agree that:
- you are legally capable of entering into binding contracts; and
- you are at least 18 years old.

- Contract Arrangement
After placing an order, you will receive an e-mail from us that will include an invoice for the goods you have ordered. Please note that this does not mean that an order has been accepted. An order from you constitutes an offer to us to buy products. All orders are subject to acceptance by us, and the contract (“contract”) will only be formed when we dispatch the goods. The contract will relate only to those products which we have dispatched. We will not be obliged to supply any other products which may have been part of your order. By initially accepting an order, Farm & Rural Supplies is under no obligation to supply the products ordered. No additions or changes may be made to an order once placed. Products will be dispatched within two working days of the order being placed on the site unless there are exceptional circumstances. You will be notified by e-mail when your order has been dispatched. Details of the products we have sent you will be listed in the e-mail. We will automatically refund you for any products we are unable to supply. Orders will be delivered to the address provided to us when you place your order on the site. Any delivery dates that may be suggested are estimates only, and we are not liable for any losses caused by late delivery or non-delivery. Ownership of the products will only pass to you when the goods are delivered to the address you requested when ordering.

- Price and Payment
The price of any products will be as quoted on the site, except in cases of obvious error. These prices exclude VAT and exclude delivery costs which will be added to the total amount due. Prices are liable to change at any time, but changes will not affect any orders you have placed prior to the date of the change and which we have accepted. It is always possible that, despite our best efforts, some of the products listed on our site may be incorrectly priced. We will normally verify prices as part of our dispatch procedures so that, where a product’s correct price is less than our stated price, we will charge the lower amount when dispatching the product to you. If a product’s correct price is higher than the price stated on the site, we will normally, at our discretion, either contact you for instructions before dispatching the product, or reject your order and notify you of such rejection. We are under no obligation to provide the product to you at the incorrect (lower) price, even after we have notified you that your order has been dispatched, if the pricing error is obvious and unmistakeable and could have reasonably been recognised by you as a mispricing. Payment for all products must be by credit or debit card. We accept most major credit and debit cards including Visa, MasterCard and Maestro. Farm & Rural Supplies will charge your chosen payment method, prior to dispatching goods.

- Refunds and Returns
You have 14 days from the day after you receive your order to either, return any unwanted items or tell us you would like to do so. Once you have let us know, you then have a further 14 days to complete your return. Unwanted items must be returned unused, with labels attached and in the original packaging.
Before you return any products to us, please contact us and we will provide you with a unique return code. For your protection, we recommend that you always use a recorded delivery service to return the products as we will not refund any costs until we receive them.

- For products that have been delivered in error, we will refund the full value of those products and the costs of returning them.
- For products that arrived damaged, we will offer you a replacement and refund you the cost of returning the product to us.
- If you return a product which you are unsatisfied with for any reason other than the product being damaged or delivered in error, you will only be refunded the price you paid for the product; no carriage will be refunded.

Where we are unable to supply a product, you have ordered and paid for, we will automatically refund you the amount paid for the product as soon as reasonably possible. We will usually refund any money received from you using the same method originally used by you to pay for your purchase. - Consumer Rights
As a consumer, you may cancel a contract at any time within 14 days, beginning on the day after you received the products. In this case, you will receive a full refund of the price paid for the product in accordance with our Refunds and Returns Policy unless you have waived this right by using the products before the end of this 14-day period. To cancel a contract, you must inform us by e-mail. E-mails should be sent to info@farmandruralsupplies.co.uk This provision does not affect your statutory rights.

- Limitation of Liability
Our liability for losses you suffer as a result of us breaking this agreement is strictly limited to the purchase price of the product you purchased.
We will not be liable to you for any loss or damage where: –

- there is no breach of a legal duty owed to you by us,
- such loss or damage is not a reasonably foreseeable result of any such breach,
- any increase in loss or damage results from a breach by you or any term in this contract,
- notwithstanding the foregoing, nothing in these Terms and Conditions is intended to limit your statutory rights or limit our liability to you for any death or personal injury resulting from our negligence.

This website contains copyrighted material, trademarks, and other proprietary information, including, but not limited to, text, software, photos, video, graphics, music and sound and the entire content of the website is copyrighted as a collective work under UK and International copyright laws. We own a copyright in the selection, coordination, arrangement, and enhancement of such content, as well as in the content original to it. You may not modify, publish, transmit, participate in the transfer or sale, create derivative works or in any way exploit, any of the content, in whole or in part. - Events outside our control
We will not be liable or responsible for any failure to perform, or delay in performance of, any of our obligations under a contract that is caused by events outside our reasonable control (a “Force Majeure Event”) including without limitation strikes, lock-outs or other industrial action by third parties, civil commotion, riot, invasion, terrorist attack or threat of terrorist attack, war (whether declared or not) or threat or preparation for war, fire, explosion, storm, flood, earthquake, subsidence, epidemic or other natural disaster, or failure of public or private telecommunications networks or impossibility of the use of railways, shipping, aircraft, motor transport or other means of public or private transport. Our performance under any contract is deemed to be suspended for the period that the Force Majeure Event continues, and we will have an extension of time for performance for the duration of that period. We will use our reasonable endeavours to bring the Force Majeure Event to a close or to find a solution by which our obligations under the contract may be performed despite the Force Majeure Event.

- Communications between us
Information or communications that we are required to send to you “in writing” will include e-mails. When using our site, you accept that communication with us will be mainly electronic. We will contact you by e-mail or provide you with the information by posting notices on the site. For contractual purposes you agree to this electronic means of communication and you acknowledge that all contracts, notices, information, and other communications that we provide to you electronically, comply with any legal requirement that such communications be in writing. - The contract between you and us is binding on you and us and on our respective successors and assigns. You may not transfer, assign, charge or otherwise dispose of a contract, or any of our rights or obligations arising under it, at any time during the term of the contract.

- Any variation to these Terms and Conditions shall have no effect unless expressly agreed in writing and signed by one of our authorised representatives.
- The information and materials contained in these pages – and the terms, conditions, and descriptions that appear – are subject to change. Your eligibility for particular products is subject to final determination and acceptance by us.
- The contents of these Terms and Conditions do not affect your Statutory Rights.
- Each of the paragraphs of these Terms and Conditions operates separately. If any court or relevant authority decides that any of them are unlawful or unenforceable, the remaining paragraphs will remain in full force and effect.
- Please note that these Terms are governed by English Law. This means a Contract for the purchase of Products through our site and any dispute or claim arising out of or in connection with it will be governed by English law. You and we both agree to that the courts of England and Wales will have non-exclusive jurisdiction. However, if you are a resident of Northern Ireland you may also bring proceedings in Northern Ireland, and if you are a resident of Scotland, you may also bring proceedings in Scotland.
